EU AI Act (and hiring)
The EU AI Act is the European Union's regulation of artificial intelligence, using a risk-based framework. AI systems used for recruitment, candidate selection and employment decisions are classified as high-risk, which brings obligations around risk management, data governance, transparency, human oversight and record-keeping.
High-risk classification means obligations fall on both the provider of the system and, importantly, the deployer — the employer using it. Assuming your vendor has handled compliance on your behalf is not a safe assumption.
Obligations phase in over time and the detail continues to develop. This is a summary for orientation, not legal advice: take advice specific to your jurisdiction and your use.
